PROPERTY TRADE THROUGH THE REAL-ESTATE AGENCY IS THE BEST FOR BUYER/SELLER'S INTEREST

Real estate agencies are the same as other professional businesses, educated and expert in their area. As each master is trained to perform professional tasks, each doctor specialized in his area, real estate agencies specialize in real estate buying/selling.

Many will tell the famous sentence: "I will not do anything through real estate agency, they will just take my money!". Dear respected potential sellers / buyers, you are living in mischief.

WHAT IS PRIORITY TO SELL / BUY A REAL ESTATE THROUGH A REAL ESTATE AGENCY?

The buying process is never easy. It is complicated by the legal regulations and procedures that accompany the purchase itself, and the smallest error in the purchase process can complicate the entire process, and eventually cost you far more.

Here's an example of just starting checks when taking over the property:

- depth check of documentation on how good the papers are (ownership, construction, utility, energy certificate, title deed, etc.). Agents also warn you if something is missing from your paper.

- When the regularity of the documentation related to the property is confirmed, a mediation contract is signed and the agency announces the real estate.

IMPORTANT:

  • Agencies pay large amounts of money to advertise real estate from their clients (home portals, foreign portals, paid ads, Google advertising, social networking, etc.), which YOU as sellers do not pay anything.
  • Agents bring potential buyers to the real estate view, more than once, and again sellers do not pay anything.
  • Agents translate the documentation, negotiate the price in the interest of their vendors, solve paperwork, lawyers, sell the entire process independently, negotiate about the price, suggest possible repayment options, and your dear sellers do not pay anything.
  • The agency receives its commission fee for the completed work at the end, so you need to understand the risks and the cost taken by the agencies.

CLEAN DOCUMENTATION 

There are several important items related to the "clean paperwork" of real - estate. 

Ownership sheet - land registry extract (abbreviated LR – in Croatian - ZK uložak) on which the data of the owner / owners of the building / land are duly written. Possible problem of ownership can arise for a number of reasons: more owners under the same number LR extract (the sale of course depends on the agreement between the owners), mortgages - the owner of the object / land in kind is not the person who is addressed as the owner, but the bank or other credit institution which has taken out a mortgaged property and the like. 

Building permit - is a document (administrative act - a decision) on the basis of which the construction of a building can begin. It determines that the preliminary design is made in accordance with the regulations and the stipulated conditions that the building must fulfill at a particular location and that all the necessary prerequisites for construction have been fulfilled. However, a possible problem occurs when someone builds an additional floor, so the building permit issued for the first state is no longer valid, since the rest of the construction is not introduced into the same. It’s a common situation in Croatia.  

Usage permit - useful permit is the final certificate of the legality of the facility and the license for its use. It also shows that the building was built according to the project. Let's rely on the previously stated problem of the branch of additional elements outside the construction permit, the same applies to this one. The use permit is not valid if changes were made to the object outside the project documentation. 

Personal document - when an agency asks you for an insight into a personal document, it is not their intention to hijack your data or trade it, but compare whether the owner of the property is really the one on the LR extract and other papers that are given for inspection. Because otherwise neighbor Marko can sell the land from his cousin Ivan, and that cousin Ivan does not know that. 

Dear sellers, you must keep in mind, in order to bring serious buyers to the real estate, it is in your interest to have proper documentation, whatever you do business through the agency or not. The process of purchasing itself is faster and easier to implement when you have clean documentation of real-estate.

PURCHASE OF FOREIGN CITIZENS IN CROATIA

We have pointed out in the previous article, some important elements related to the obtaining of paperwork for foreigners and buying/selling of 'real estate in Croatia, we need to point out a few more important things.

Examples from experience. Buyers decided not to do business over the agency (because it was cheaper). 

Example from practice 1.

A foreign citizen decided to buy construction land to build his dream home in Croatia. He decided that he would not purchase real estate through real estate agency. He found the land, arranged everything independently with the seller. However, after the sale was completed, problems for the customer began. It turned out that the land was not a building lot, and the buyer could not build anything on it. When entering the new owner, problems were also encountered. There were several persons in the ownership of the land. And of course, not everyone was willing to sell that land. The court case related to this transaction continues (over 10 years), the dispute is still unresolved and the costs are only accumulating ... 

Example from Practice 2.

The foreign buyer has decided to find the real estate of his dreams independently. He bought a house in Croatia. However, the buyer did not know he had bought a house with the burden of court dispute. The seller withheld the truth about court dispute on the house from buyer, and the buyer did not know it. Its "super price" without intermediaries, has increased far more (costs of lawyer, court, time spent, etc.).
